A 22-year-old Niagara-on-the-Lake man is facing impaired driving and hit-and-run charges after a migrant worker from Mexico was killed while cycling in rural Niagara-on-the-Lake late on Friday night.

Niagara Regional Police say officers were called to Concession 6 Road near Line 4 Road at about 11:40 p.m. Friday after receiving reports that a cyclist had been struck by a vehicle.

Police said the cyclist died at the scene.

The victim, identified in court documents as Sinhue Garcia, worked at the massive St. David’s Hydroponics plant on Concession 7 in rural NOTL. His wife also works at the facility.

Investigators allege the driver left before emergency crews arrived and did not report the collision. A man was arrested a few hours later.

Police said officers from 2 District and the traffic enforcement unit found the suspected vehicle and driver at another location in NOTL. The driver was arrested and the vehicle was seized for examination.

Gavin Devries, 22, of NOTL, is charged with failure to stop after an accident resulting in death, impaired operation causing death and having a blood-alcohol level over .08.

The charges have not been proven in court. Devries was released on bail Monday and ordered to live at his family’s home on Line 6. He also was banned from driving.

The investigation is continuing and is being led by the Niagara police collision reconstruction unit, with assistance from the forensic services unit.

Police are asking anyone who witnessed the collision or has dash camera or surveillance footage from the area around the time of the crash to contact investigators.

Several farmworkers have been struck and killed on rural roads over the years in NOTL.

In 2019, a woman known only as Zenaida, who worked at both Tregunno Fruit Farms and St. David’s Hydroponics, was killed while walking along Concession 7, not far from the latest crash scene.

Patrick McCabe of Pelham was sentenced to two years in prison in that incident.
